3.2.5 Board Dismissal

Narrative:

The state constitution (Article VIII, Section IV, Paragraph I) states “The qualifications, compensation, and removal from office of the members of the board of regents shall be as provided by law.”[1] Two sections of the Georgia State Code deal with possible dismissal.  The first section is the “Education” section and has a specific statement regarding members of the BOR.  Code Section 20-3-26 specifies that board members may be removed by the BOR Chair for non-participation in BOR meetings.[2] The second relevant section, Georgia State Code Section 45, “Public Officers and Employees,” has a specific sub-section (45-5-1) [3] on the removal of any public officials in the State of Georgia; this sub-section covers conditions precipitating removal, due process, and possible recourse.
